Court to Reexamine Ruling That Permitted Former President to Send Military Forces to Oregon City

The ninth circuit court has upheld a ban on sending state troops in the Oregon city, after a latest court ruling.

Appeals Court Concurs to Reconsider Case

The ninth circuit court of appeals decided on Tuesday that it would rehear the case concerning the executive power with an larger group of 11 judges. The court also overturned a earlier decision from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Military Presence

This legal directive represents the most recent turn in a long-running court case over whether the former president has the authority and justification to deploy state military units in the city. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in response to months of protests.

Conflicting Arguments

The administration has claimed that government employees at the ICE facility in south Portland were under attack, while local authorities maintain that local officers have command of the situation.

Contrary to descriptions of Portland as “war ravaged”, residents have been posting videos of lush hiking trails and a vibrant culinary culture, and planning activities such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city issued two temporary restraining orders this period – one blocking the federalization of the Oregon national guard, and another stopping the deployment of any military personnel in Oregon, after attempts to evade the first order by mobilizing out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the physical sending of the troops.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with all decisions under review simultaneously – by a panel of 11 judges.

“This decision demonstrates that facts are important and that the courts are working to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a testing site for unchecked federal authority,” said the legal representative in a official comment.

“The judicial body is sending a clear message: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting Oregon’s laws, values, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
